Violations of Probation and Early Termination

When a probation officer alleges you have violated any of the terms of your probation you will be brought back before the trial judge for what is essentially a "re-sentencing." Since the standard of proof on a VOP is so much lower than the original criminal charge that landed you on probation, any VOP is very serious. Whether facing technical violations (financial) or substantive violations (failing drug test, new law violation, absconding, etc.), the consequences can be a term of incarceration in the county jail or state prison. Even with a minor violation, your could be sentenced to any lawful term of incarceration you could have originally received instead of probation plus additional points for the VOP itself.
